Introduction and Acceptance of Terms
Welcome to the Politis Steak & Seafood website (the "Site"), operated by Politis Specialty Foods LLC (doing business as Politis Steak & Seafood) ("Politis", "we", "us", or "our"). These Terms and Conditions of Use ("Terms") govern your use of our Site and any services or products provided through the Site. By accessing or using the Site, you agree to be bound by these Terms. Product Information and Orders
We strive to ensure that all product descriptions, images, and pricing on our Site are accurate. However, mistakes can occur. Politis does not guarantee that product descriptions or other content on the Site are error-free, complete, or current. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after you have submitted an order).
By placing an order through our Site, you are making an offer to purchase the products in your cart. All orders are subject to acceptance by Politis. We reserve the right to accept or reject any order for any reason, including but not limited to product availability, errors in pricing or product information, or issues identified by our fraud prevention processes. If we cancel an order, we will notify you and refund any amounts paid.
Prices for our products are listed in U.S. dollars and do not include applicable taxes or shipping charges (unless stated otherwise). Applicable taxes and shipping fees will be added at checkout. You agree to pay all charges applicable to your order, including product price, shipping, and any taxes.
Payment
We use secure payment processors to handle financial transactions. By providing a payment method, you represent that you are authorized to use the payment method and you authorize our third-party payment processor to charge the full amount of your order (including any applicable taxes and shipping costs) to that payment method. We do not collect or store your full credit card information on our own servers; payment details are handled by our compliant payment provider. If your payment method fails or is declined, we have no obligation to fulfill your order.
Shipping and Risk of Loss
All purchases from our Site are made pursuant to our Shipping and Returns Policy, which is incorporated herein by reference. Please review that policy for details on shipping methods, delivery times, and how we handle issues like late delivery or product damage in transit. Title to products and risk of loss or damage during shipping pass to you when we deliver the products to the carrier, except as otherwise provided in the Shipping and Returns Policy. It is your responsibility to ensure that the shipping address you provide is correct and that someone is available to receive perishable shipments. Politis is not responsible for orders that are lost, stolen, or spoiled due to incorrect shipping addresses or unattended deliveries.
Returns and Refunds
Our products are perishable food items, and as such, we generally do not accept returns on them for health and safety reasons. Any issues with your order will be handled in accordance with our Shipping and Returns Policy. If you experience a problem with your shipment (such as receiving the wrong item or a product arriving in poor condition), please refer to the Shipping and Returns Policy for instructions on reporting the issue promptly. We will work with you to find an appropriate solution, which may include a replacement or refund when justified.

To the fullest extent permitted by law, Politis disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not make any guarantees regarding the accuracy, reliability, or completeness of any information on the Site, including product availability, descriptions, and prices. Limitation of Liability

This includes, but is not limited to, damages for lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, even if Politis has been advised of the possibility of such damages.
In no event shall Politis's total liability to you for all claims arising from or related to your use of the Site or products purchased through the Site exceed the amount you paid to Politis for the specific product(s) at issue, or one hundred U.S. dollars (USD $100), whichever is greater. The foregoing limitations shall apply to the fullest extent permitted by law in the applicable jurisdiction.
Certain state laws do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. In such states, Politis’s liability shall be limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Politis Specialty Foods LLC (d/b/a Politis Steak & Seafood) and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site or products purchased through the Site; (b) your violation of these Terms or any law or regulation; or (c) your infringement of any intellectual property or other rights of any third party.
Politis reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter). In such case, you agree to cooperate with our defense of such claim.
Termination
We may terminate or suspend your access to the Site, with or without notice, for any conduct that we, in our sole discretion, believe is disruptive to the Site or is in violation of these Terms or any applicable law. Upon termination, your right to use the Site will immediately cease. The provisions of these Terms that by their nature should survive termination (such as intellectual property rights, warranty disclaimers, limitations of liability, and indemnification) shall continue in effect after termination.
Governing Law and Jurisdiction
These Terms and your use of the Site and purchase of products shall be governed by the laws of the State of Florida, USA, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site shall be brought in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and Shipping and Returns Policy and any other legal notices or policies published by Politis on the Site, constitute the entire agreement between you and Politis regarding the use of the Site and supersede any prior agreements (oral or written) relating to the same subject matter.
Waiver
Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. Any waiver of these Terms by Politis must be in writing and signed by an authorized representative of Politis.
